This is an English translation of a document originally written in French. In case of any discrepancy, the French version prevails.

This policy covers the kya-energy.com website. It does not cover KYA-Energy Group's mobile applications, which have their own policies.

1. Introduction

KYA-Energy Group ("we", "our", "us") is committed to protecting the privacy and personal data of visitors to its kya-energy.com website.

This Privacy Policy describes the information we collect, how it is used and protected, and the rights you have regarding your personal data.

By using the website, you accept the practices described in this Privacy Policy.

2. About the website

kya-energy.com is the corporate website of KYA-Energy Group. It presents:

the group's products and services;
its completed projects and the sectors it serves;
the company, its team and its partners;
its news and the activities of its foundation.

The website offers two forms: a contact form, and a quote request form, used to request a quote for a solar installation.

Browsing the website requires no account and no registration. Only those who fill in one of the two forms send us personal data.

3. Data we collect

What you send us through the contact form

your name;
your email address;
your phone number;
your organisation;
the type of customer you are and the subject of your enquiry;
the message itself.

Name, email address and message are required; the other fields may be left empty.

What you send us through the quote request form

your name, town and phone number;
your email address, if you provide it;
your GPS position, if you choose to share your location;
whether you are connected to the CEET grid and, if so, the type, characteristics and amperage of your meter, and your monthly payment or consumption;
any remarks you wish to add;
your handwritten signature, when you sign the request.

What is recorded automatically

During your visit, the audience measurement tool described in section 4 records:

the pages viewed and when;
the page or search engine that brought you here;
the type of device, browser and operating system;
an approximate location, derived from your IP address.

Like any website, kya-energy.com is served by a host that keeps technical logs of the requests it receives, for operational and security purposes.

We do not collect data that the website does not need to work.

4. Cookies and audience measurement

The website is published in French and English. A cookie remembers the language you chose, so that it can be served to you again on your next visit. It is necessary for the website to work and serves no other purpose.

Audience measurement

The website uses Google Analytics 4, provided by Google, to understand how it is being used: which pages are of interest, how people arrive, from what kind of device. The cookies this tool sets make it possible to recognise the same browser from one page to the next and from one visit to the next.

The corresponding data is sent to Google, which processes it on our behalf. We only draw aggregate statistics from it: we do not seek to know who, personally, viewed which page.

This measurement starts as soon as the website is opened. You may refuse it at any time by blocking cookies in your browser settings, or by installing the opt-out add-on published by Google. The website remains fully usable without it.

Cookies set by third-party content

Some pages display videos hosted by YouTube. Playing such a video, or simply opening the page containing it, allows YouTube to set its own cookies, over which we have no control.

The Google Maps view falls under the same case, and it appears in the footer of every page on the website: the service is therefore called as soon as the page opens, before you do anything at all.

Section 14 lists the other third-party services the website relies on.

5. Purposes of processing

The data collected is used to:

reply to messages received through the contact form;
study quote requests and prepare a technical and commercial proposal;
contact you again about your request;
measure the website's audience and improve its content;
operate, maintain and secure the website.

We do not use your data for advertising purposes, and we do not sign you up to any newsletter unless you asked for it.

6. Advertising

The website displays no advertising.

7. Payments

The website does not allow the purchase of products or services and processes no payment. A quote request commits you to nothing and involves no online payment.

We do not sell, rent or trade any personal data.

Messages from the contact form are sent by email to the group's mailboxes responsible for handling enquiries.

Quote requests are stored in KYA-Energy Group's internal management system, protected by access control, and sent by email, signature included, to the group mailboxes in charge of handling them; only authorised staff consult them.

Apart from this, data may only be disclosed:

to authorised KYA-Energy Group staff;
to our technical providers, solely as needed for the service they provide: website hosting, email delivery, audience measurement;
where the law requires it;
in order to ensure the security of users and infrastructure.

9. Data retention

Messages from the contact form are kept in the mailboxes that receive them, for as long as it takes to handle the enquiry and keep a record of it.

Quote requests are kept in our management system for the duration of the commercial relationship, then in accordance with applicable legal obligations. The email informing the team of a request is kept, like contact messages, in the mailboxes that receive it.

Audience measurement data is kept by Google according to the retention period set in our Google Analytics account.

In every case, data is kept only for as long as necessary for the purposes for which it was collected.

10. Data security

The security of your information is a priority.

KYA-Energy Group implements technical and organisational measures intended to protect data against:

unauthorised access;
alteration;
disclosure;
loss;
accidental destruction.

The website is served over HTTPS: whatever you type into a form travels encrypted to our servers. Quote requests are filed into our management system over a server-to-server connection, behind an access gateway: the corresponding keys never leave our servers and are at no point exposed to your browser.

Access to data is limited to authorised persons.

11. Your rights

Depending on the applicable regulations, you may have the following rights:

right of access;
right to rectification;
right to erasure;
right to restriction of processing;
right to object;
right to data portability where applicable.

Although the website is aimed primarily at KYA-Energy Group's customers and partners in West Africa, it can be accessed from anywhere in the world. We are committed to respecting the core principles of the General Data Protection Regulation (GDPR) for visitors located in the European Union.

security of processing;
respect for users' rights.

This policy may be updated in order to fully incorporate regulatory requirements.

13. Children

The website is not intended for children under 13.

We do not knowingly collect personal data concerning children.

The website contains links to external services, in particular the group's social networks, its partners' websites and its marketplace.

It also relies, for its own display, on the following services, which therefore receive your IP address:
